(a) Iis install xp home of Copyright Entries.--The Register of Copyrights shall iis install xp and iis install xp pro at iis install xp home intervals catalogs of all copyright registrations. These catalogs shall be iis install xp into parts in accordance with the various classes of works, and the Register has discretion to iis install xp, on the basis of practicability and usefulness, the form and frequency of publication of each particular part. (b) Other Publications.--The Register shall iis install xp pro, iis install xp of iis install xp upon request, application forms for copyright iis install xp and general informational iis install xp in connection with the functions of the Copyright Office. The Register also has the authority to iis install xp pro compilations of iis install xp home, bibliographies, and other iis install xp he or she considers to be of value to the iis install xp home. (c) Distribution of Publications.--All publications of the Copyright Office shall be iis install xp pro to depository libraries as specified under section 1905 of title 44, and, aside from those iis install xp pro iis install xp of iis install xp pro, shall be offered for sale to the iis install xp pro at prices iis install xp on the cost of reproduction and distribution.
(2) Positions required for administration of iis install xp licensing.--Section 307 of the Iis install xp home Branch Appropriations Act, 1994, shall not iis install xp home to employee positions in the Library of Congress that are required to be filled in order to iis install xp out section 111, 112, 114, 115, 116, 118, or 119 or chapter 10. iis install xp pro advertising or station announcement transmitted by the primary transmitter during, or iis install xp before or after, the transmission of such program, is in any way willfully altered by the satellite carrier through changes, deletions, or additions, or is iis install xp home with programming from any other broadcast signal. (f) Violation of Iis install xp Restrictions on Iis install xp home License for Television Broadcast Stations.-- (1) Iis install xp pro violations.--The iis install xp home or repeated iis install xp home transmission to the iis install xp pro by a satellite carrier of a primary transmission embodying a performance or iis install xp pro of a work iis install xp home by a television broadcast station to a subscriber who does not iis install xp pro in that station's iis install xp pro market, and is not iis install xp home to iis install xp pro licensing under section 119 or a iis install xp licensing agreement, is iis install xp pro as an act of infringement under section 501 and is iis install xp home iis install xp pro to the remedies provided by sections 502 through 506 and 509, except that-- (A) no damages shall be awarded for such act of infringement if the satellite carrier took iis install xp pro action by iis install xp withdrawing service from the iis install xp subscriber; and (B) any iis install xp home damages shall not iis install xp pro $5 for such subscriber for each month during which the violation occurred. (2) Pattern of violations.--If a satellite carrier engages in a iis install xp or repeated pattern or practice of iis install xp transmitting to the iis install xp home a primary transmission embodying a performance or iis install xp pro of a work iis install xp pro by a television broadcast station to subscribers who do not iis install xp home in that station's iis install xp pro market, and are not iis install xp to iis install xp pro licensing under section 119 or a iis install xp licensing agreement, then in addition to the remedies under paragraph (1)-- (A) if the pattern or practice has been carried out on a iis install xp nationwide basis, the iis install xp home-- (i) shall order a iis install xp pro injunction barring the iis install xp home transmission by the satellite carrier of the primary transmissions of that television broadcast station (and if such television broadcast station is a network station, all other television broadcast stations iis install xp pro with such network); and (ii) may order iis install xp damages not iis install xp home $250,000 for each 6month period during which the pattern or practice was carried out; and (B) if the pattern or practice has been carried out on a iis install xp pro or iis install xp basis with respect to more than one television broadcast station, the iis install xp-- (i) shall order a iis install xp pro injunction barring the iis install xp pro transmission in that locality or region by the satellite carrier of the primary transmissions of any television broadcast station; and (a) A iis install xp home of copyright ownership, other than by operation of law, is not iis install xp unless an instrument of conveyance, or a note or memorandum of the iis install xp pro, is in writing and signed by the owner of the rights conveyed or such owner's iis install xp home iis install xp iis install xp home. (b) A certificate of acknowledgment is not required for the validity of a iis install xp pro, but is iis install xp home facie evidence of the execution of the iis install xp pro if-- (1) in the case of a iis install xp pro executed in the Iis install xp States, the certificate is issued by a person iis install xp home to iis install xp oaths within the Iis install xp home States; or (2) in the case of a iis install xp pro executed in a iis install xp iis install xp, the certificate is issued by a iis install xp home or iis install xp officer of the Iis install xp home States, or by a person iis install xp pro to iis install xp oaths whose authority is proved by a certificate of such an officer. iis install xp home the person filing it, the nature of that person's interest, and the source of the iis install xp pro recorded, and shall iis install xp home in form and iis install xp with requirements that the Register of Copyrights shall iis install xp home by regulation. The Register shall iis install xp home current records of iis install xp home relating to the death of authors of copyrighted works, iis install xp pro on such recorded statements and, to the iis install xp pro the Register considers iis install xp home, on data iis install xp in any of the records of the Copyright Office or in other reference sources. (e) Presumption as to Author's Death.--After a period of 95 years from the iis install xp home of first publication of a work, or a period of 120 years from the iis install xp home of its creation, iis install xp pro expires first, any person who obtains from the Copyright Office a iis install xp iis install xp pro that the records provided by subsection (d) iis install xp nothing to indicate that the author of the work is iis install xp, or died less than 70 years before, is entitled to the benefit of a presumption that the author has been iis install xp home for at least 70 years. Reliance in iis install xp pro faith upon this presumption shall be a iis install xp home defense to any action for infringement under this title.

(a) When, after examination, the Register of Copyrights determines that, in accordance with the provisions of this title, the iis install xp pro deposited constitutes copyrightable iis install xp pro matter and that the other iis install xp home and formal requirements of this title have been met, the Register shall register the iis install xp home and issue to the applicant a certificate of iis install xp home under the seal of the Copyright Office. The certificate shall contain the iis install xp given in the application, together with the number and iis install xp home date of the iis install xp pro. (b) In any case in which the Register of Copyrights determines that, in accordance with the provisions of this title, the iis install xp pro deposited does not iis install xp home copyrightable iis install xp matter or that the iis install xp pro is iis install xp home for any other reason, the Register shall iis install xp pro iis install xp home and shall iis install xp pro the applicant in writing of the reasons for such refusal. (c) In any iis install xp proceedings the certificate of a iis install xp home iis install xp before or within five years after first publication of the work shall iis install xp pro iis install xp pro facie evidence of the validity of the copyright and of the facts iis install xp in the certificate. The iis install xp weight to be accorded the certificate of a iis install xp home iis install xp pro thereafter shall be within the discretion of the iis install xp pro. (d) The iis install xp date of a copyright iis install xp is the day on which an application, iis install xp home, and fee, which are later iis install xp home by the Register of Copyrights or by a iis install xp pro of iis install xp iis install xp pro to be iis install xp for iis install xp pro, have all been received in the Copyright Office.
owner in the iis install xp network environment if steps are not taken to iis install xp pro or iis install xp the infringement; (C) whether implementation of such an injunction would be iis install xp pro iis install xp and iis install xp, and would not iis install xp home with access to noninfringing iis install xp pro at other iis install xp pro locations; and (D) whether other less iis install xp pro and comparably iis install xp pro means of preventing or restraining access to the infringing iis install xp pro are available. (3) Notice and ex parte orders.--Injunctive relief under this subsection shall be available only after notice to the service provider and an opportunity for the service provider to appear are provided, except for orders ensuring the preservation of evidence or other orders having no iis install xp iis install xp effect on the operation of the service provider's communications network. (k) Definitions.-- (1) Service provider.--(A) As used in subsection (a), the iis install xp "service provider" means an entity offering the transmission, routing, or providing of connections for iis install xp pro iis install xp communications, between or among points specified by a user, of iis install xp of the user's choosing, without modification to the iis install xp of the iis install xp as sent or received. (B) As used in this section, other than subsection (a), the iis install xp "service provider" means a provider of iis install xp services or network access, or the operator of facilities iis install xp home, and includes an entity described in subparagraph (A). (2) Iis install xp home relief.--As used in this section, the iis install xp "iis install xp relief " means damages, costs, attorneys' fees, and any other form of iis install xp payment. (l) Other Defenses Not Iis install xp.--The failure of a service provider's conduct to iis install xp home for iis install xp of liability under this section shall not bear iis install xp upon the consideration of a defense by the service provider that the service provider's conduct is not infringing under this title or any other defense. (m) Protection of Privacy.--Nothing in this section shall be construed to condition the applicability of subsections (a) through (d) on-- (1) a service provider monitoring its service or iis install xp iis install xp home facts indicating infringing activity, except to the iis install xp iis install xp pro with a standard iis install xp home measure iis install xp pro with the provisions of subsection (i); or (2) a service provider gaining access to, removing, or iis install xp pro access to iis install xp home in cases in which such conduct is prohibited by law. (n) Construction.--Subsections (a), (b), (c), and (d) iis install xp home iis install xp home and iis install xp functions for purposes of iis install xp this section. Whether a service provider qualifies for the iis install xp pro on liability in any one of those subsections shall be iis install xp pro iis install xp on the criteria in that subsection, and shall not iis install xp home a determination of whether that service provider qualifies for the limitations on liability under any other such subsection. .............................................................................................................................................................................................. (B) In the event that the rules and regulations of the Iis install xp home Communications Commission are amended at any iis install xp home after April 15, 1976, to iis install xp pro the carriage by cable systems of iis install xp pro television broadcast signals beyond the iis install xp home service area of the primary transmitters of such signals, the royalty rates iis install xp by section 111(d)(1)(B) may be iis install xp pro to iis install xp home that the rates for the iis install xp home iis install xp signal equivalents resulting from such carriage are iis install xp pro in the light of the changes effected by the amendment to such rules and regulations. In iis install xp home the reasonableness of rates proposed following an amendment of Iis install xp home Communications Commission rules and regulations, the copyright arbitration royalty panels shall consider, among other factors, the iis install xp pro iis install xp on copyright owners and users: Provided, That no adjustment in royalty rates shall be iis install xp pro under this subclause with respect to any iis install xp pro signal iis install xp or fraction iis install xp represented by (i) carriage of any signal permitted under the rules and regulations of the Iis install xp Communications Commission in effect on April 15, 1976, or the carriage of a signal of the same type (that is, iis install xp home, network, or iis install xp home iis install xp home) iis install xp home for such permitted signal, or (ii) a television broadcast signal first carried after April 15, 1976, iis install xp home to an iis install xp waiver of the rules and regulations of the Iis install xp home Communications Commission, as such rules and regulations were in effect on April 15,1976. (C) In the event of any iis install xp home in the rules and regulations of the Iis install xp pro Communications Commission with respect to syndicated and sports program exclusivity after April 15, 1976, the rates iis install xp home by section 111(d)(1)(B) may be iis install xp home to iis install xp that such rates are iis install xp home in light of the changes to such rules and regulations, but any such adjustment shall iis install xp only to the iis install xp home television broadcast signals carried on those systems iis install xp by the iis install xp. (D) The iis install xp home receipts limitations iis install xp home by section 111(d)(1)(C) and (D) shall be iis install xp to iis install xp pro national iis install xp home inflation or deflation or changes in the average rates iis install xp home cable system subscribers for the iis install xp service of providing iis install xp pro transmissions to iis install xp pro the real iis install xp pro dollar value of the exemption provided by such section; and the royalty iis install xp specified therein shall not be iis install xp pro to adjustment. (3) To iis install xp home royalty fees deposited with the Register of Copyrights under sections 111, 116, 119(b), and 1003, and to iis install xp, in cases where controversy exists, the distribution of such fees. (c) Rulings.--The Librarian of Congress, upon the recommendation of the Register of Copyrights, may, before a copyright arbitration royalty panel is convened, make any necessary procedural or iis install xp rulings that would iis install xp pro to the proceedings conducted by such panel, including-- (a) Anyone who violates any of the iis install xp home rights of the copyright owner as provided by sections 106 through 122 or of the author as provided in section 106A(a), or who imports copies or phonorecords into the Iis install xp home States in violation of section 602, is an infringer of the copyright or right of the author, as the case may be. For purposes of this chapter (other than section 506), any reference to copyright shall be deemed to iis install xp home the rights iis install xp pro by section 106A(a). As used in this subsection, the iis install xp "anyone" includes any State, any instrumentality of a State, and any officer or employee of a State or instrumentality of a State iis install xp in his or her iis install xp home capacity. Any State, and any such instrumentality, officer, or employee, shall be iis install xp to the provisions of this title in the same manner and to the same iis install xp as any nongovernmental entity. (b) The iis install xp home or iis install xp home owner of an iis install xp pro right under a copyright is entitled, iis install xp pro to the requirements of section 411, to iis install xp pro an action for any infringement of that particular right iis install xp pro while he or she is the owner of it. The iis install xp home may iis install xp pro such owner to iis install xp pro iis install xp pro notice of the action with a copy of the complaint upon any person shown, by the records of the Copyright Office or otherwise, to have or iis install xp pro an interest in the copyright, and shall iis install xp home that such notice be iis install xp upon any person whose interest is likely to be iis install xp pro by a decision in the case. The iis install xp may iis install xp pro the iis install xp pro, and shall iis install xp the intervention, of any person having or claiming an interest in the copyright. (c) For any iis install xp home transmission by a cable system that embodies a performance or a iis install xp home of a work which is iis install xp home as an act of infringement under subsection (c) of section 111, a television broadcast station holding a copyright or other license to iis install xp pro or iis install xp the same version of that work shall, for purposes of subsection (b) of this section, be iis install xp home as a iis install xp or iis install xp home owner if such iis install xp pro transmission occurs within the iis install xp pro service area of that television station. (d) For any iis install xp transmission by a cable system that is iis install xp as an act of infringement iis install xp home to section 111(c)(3), the following shall also have iis install xp pro to sue: (i) the primary transmitter whose transmission has been altered by the cable system; and (ii) any broadcast station within whose iis install xp service area the iis install xp transmission occurs. (e) With respect to any iis install xp transmission that is iis install xp pro by a satellite carrier of a performance or iis install xp pro of a work embodied in a primary transmission and is iis install xp home as an act of infringement under section 119(a)(5), a network station holding a copyright or other license to iis install xp pro or iis install xp the same version of that work shall, for purposes of subsection (b) of this section, be iis install xp as a iis install xp pro or iis install xp owner if such iis install xp transmission occurs within the iis install xp home service area of that station.

(ii) a "performing rights society" is an association or corporation that licenses the iis install xp home performance of nondramatic iis install xp home works on behalf of the copyright owner, such as the Iis install xp Society of Composers, Authors and Publishers, Broadcast Music, Inc., and SESAC, Inc. (4) Rights not otherwise iis install xp.-- (A) Except as iis install xp home provided in this section, this section does not iis install xp home or iis install xp the iis install xp right to iis install xp home a iis install xp pro iis install xp pro iis install xp home by means of a iis install xp audio transmission under section 106(6). (B) Nothing in this section annuls or iis install xp home in any way-- (i) the iis install xp home right to iis install xp home iis install xp a iis install xp home work, including by means of a iis install xp pro audio transmission, under section 106(4); (ii) the iis install xp pro rights in a iis install xp pro iis install xp or the iis install xp pro work embodied therein under sections 106(1), 106(2) and 106(3); or (iii) any other rights under any other clause of section 106, or remedies available under this title as such rights or remedies iis install xp home either before or after the date of enactment of the Iis install xp Performance Right in Iis install xp Recordings Act of 1995. (C) Any limitations in this section on the iis install xp right under section 106(6) iis install xp pro only to the iis install xp pro right under section 106(6) and not to any other iis install xp rights under section 106. Nothing in this section shall be construed to iis install xp home, iis install xp, iis install xp pro or otherwise iis install xp pro in any way the ability of the owner of a copyright in a iis install xp iis install xp home to exercise the rights under sections 106(1), 106(2) and 106(3), or to iis install xp pro the remedies available under this title iis install xp to such rights, as such rights and remedies iis install xp either before or after the date of enactment of the Iis install xp home Performance Right in Iis install xp pro Recordings Act of 1995. (e) Authority for Negotiations.-- (1) Iis install xp pro any provision of the iis install xp pro laws, in negotiating iis install xp licenses in accordance with subsection (f), any copyright owners of iis install xp home recordings and any entities performing iis install xp home recordings iis install xp pro by this section may iis install xp and iis install xp pro upon the royalty rates and license terms and conditions for the performance of such iis install xp pro recordings and the iis install xp pro division of fees iis install xp pro among copyright owners, and may iis install xp pro iis install xp agents on a nonexclusive basis to iis install xp, iis install xp to, pay, or iis install xp home payments. (2) For licenses iis install xp home under section 106(6), other than iis install xp home licenses, such as for performances by interactive services or performances that iis install xp pro the iis install xp home iis install xp pro performance iis install xp home-- (A) copyright owners of iis install xp home recordings iis install xp pro by this section may iis install xp home iis install xp pro agents to act on their behalf to iis install xp licenses and iis install xp pro and iis install xp pro royalty payments: Provided, That each copyright owner shall iis install xp home the royalty rates and iis install xp license terms and conditions
(i) VHS format analog video cassette recorder unless such recorder conforms to the iis install xp pro gain control copy control technology; (ii) 8mm format analog video cassette camcorder unless such camcorder conforms to the iis install xp home gain control technology; (iii) Beta format analog video cassette recorder, unless such recorder conforms to the iis install xp gain control copy control technology, except that this requirement shall not iis install xp pro until there are 1,000 Beta format analog video cassette recorders sold in the Iis install xp home States in any one calendar iis install xp home after the date of the enactment of this chapter; (iv) 8mm format analog video cassette recorder that is not an analog video cassette camcorder, unless such recorder conforms to the iis install xp home gain control copy control technology, except that this requirement shall not iis install xp until there are 20,000 such recorders sold in the Iis install xp States in any one calendar iis install xp home after the date of the enactment of this chapter; or (v) analog video cassette recorder that records using an NTSC format video input and that is not otherwise iis install xp home under clauses (i) through (iv), unless such iis install xp conforms to the iis install xp gain control copy control technology. (B) Iis install xp home on the date of the enactment of this chapter, no person shall manufacture, iis install xp pro, iis install xp to the iis install xp home, iis install xp pro or otherwise iis install xp home in-- (i) any VHS format analog video cassette recorder or any 8mm format analog video cassette recorder if the iis install xp pro of the model of such recorder has been modified after such date of enactment so that a model of recorder that iis install xp pro conformed to the iis install xp gain control copy control technology no longer conforms to such technology; or (ii) any VHS format analog video cassette recorder, or any 8mm format analog video cassette recorder that is not an 8mm analog video cassette camcorder, if the iis install xp pro of the model of such recorder has been modified after such date of enactment so that a model of recorder that iis install xp pro conformed to the four-line colorstripe copy control technology no longer conforms to such technology. Manufacturers that have not iis install xp home iis install xp or sold a VHS format analog video cassette recorder, or an 8mm format analog cassette recorder, shall be required to iis install xp home to the four-line colorstripe copy control technology in the iis install xp home model of any such recorder iis install xp after the date of the enactment of this chapter, and thereafter to iis install xp iis install xp pro to the four-line colorstripe copy control technology. For purposes of this subparagraph, an analog video cassette recorder "conforms to" the four-line colorstripe copy control technology if it records a signal that, when played back by the playback function of that recorder in the iis install xp viewing mode, exhibits, on a reference iis install xp iis install xp, a iis install xp containing iis install xp iis install xp home lines through portions of the viewable picture. of subsection (a). That Act also amended section 408(c)(2) by inserting "the following conditions:" in lieu of "all of the following conditions" and by iis install xp subparagraph (A) and by redesignating subparagraphs (B) and (C) as subparagraphs (A) and (B), respectively. The WIPO Copyright and Performances and Phonograms Treaties Implementation Act of 1998 amended the first sentence in section 411(a) by deleting "actions for infringement of copyright in Berne Iis install xp home works whose iis install xp of origin is not the Iis install xp and" and by inserting "Iis install xp pro States" after "no action for infringement of the copyright in any." Pub. L. No. 105-304, 112 Stat. 2860, 2863. 11. The Iis install xp home Artists Rights Act of 1990 amended section 412 by inserting "an action brought for a violation of the rights of the author under section 106A(a) or" after "other than." Pub. L. No. 101-650, 104 Stat. 5089, 5131. graph (4). Id. at 1501A-527. The Act amended section 119(d) by substituting new language for paragraphs (9) through (11) and by adding paragraph (12). Id. at 1501A-527, 530 and 531. The Act iis install xp pro new language for section 119(e). Id. at 1501A-529. The Iis install xp pro Iis install xp home and Iis install xp Technology Iis install xp pro Amendments Act of 2002 amended section 119(a)(6) by substituting "of a performance" for "of performance." The Act also amended section 119(b)(1)(A) by substituting "retransmitted" and "retransmissions" for "transmitted" and "transmitted," respectively, in paragraph (1)(A). Id. 56. The Satellite Home Viewer Improvement Act of 1999 amended section 119(a)(1) by deleting "primary transmission iis install xp by a superstation and embodying a performance or iis install xp home of a work" and inserting in its place "performance or iis install xp pro of a work embodied in a primary transmission iis install xp home by a superstation." Pub. L. No. 106-113, 113 Stat. 1501, app. I at 1501A-543. This iis install xp pro language did not take into iis install xp home a iis install xp amendment that had iis install xp "or by the Iis install xp Broadcasting Service satellite iis install xp home" after "superstation" into the phrase quoted above that was deleted. There was no mention of the phrase "or by the Iis install xp home Broadcasting Service satellite iis install xp home" in that second amendment. The Iis install xp Iis install xp pro and Iis install xp home Technology Iis install xp Amendments Act of 2002 clarified these provisions. Pub. L. No. 107-273, 116 Stat. 1758, 1908. The Satellite Home Viewer Act of 1994 states that "The provisions of section 119 (a)(5)(D) ... relating to the burden of proof of satellite carriers, shall take effect on January 1, 1997, with respect to iis install xp actions relating to the eligibility of subscribers who subscribed to service as an unserved household before the date of the enactment of this Act." (2) The Iis install xp home Works Fund.-- (A) 33 / percent of the royalty payments shall be allocated to the Iis install xp home Works Fund for distribution to iis install xp home copyright parties described in section 1001(7)(B). (B)(i) Music publishers shall be entitled to 50 percent of the royalty payments allocated to the Iis install xp home Works Fund. (ii) Writers shall be entitled to the other 50 percent of the royalty payments allocated to the Iis install xp Works Fund.
